Welcome to Always With Us. These Terms and Conditions govern your use of our website and services. By accessing or using our platform, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services.
Always With Us provides an online memorial platform that allows families to create memorial pages for their loved ones. Our services include memorial page creation, tribute message collection, contribution tracking via PayNow QR codes, and related administrative tools. We charge a platform hosting fee for published memorial pages.
To create a memorial page, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.
You are solely responsible for the content you upload to memorial pages, including photographs, biographies, and PayNow QR codes. You represent and warrant that you have the right to share this content and that it does not infringe on any third-party rights. We reserve the right to review, edit, or remove any content that violates these terms or is deemed inappropriate.
Always With Us provides a display service for PayNow QR codes uploaded by families. We do not process, handle, or hold any contributions made via these QR codes. All transactions occur directly between the visitor and the family. We are not responsible for any disputes, errors, or losses arising from contribution transactions. For regulatory purposes, families may be required to upload a death certificate as proof when displaying a PayNow QR code on our platform.
A platform hosting fee of SGD $88 is payable for each published memorial page, covering a period of one year from the date of publication. All fees must be paid before a memorial page can be published. Fees are non-refundable except where required by law.
Users may not use our platform for any unlawful purpose or in any way that could damage, disable, or impair our services. Prohibited activities include but are not limited to: posting defamatory, obscene, or offensive content; impersonating others; uploading malicious software; scraping or data mining our platform; and engaging in fraudulent transactions.
All content, trademarks, and intellectual property on the Always With Us platform are owned by us or our licensors. You may not reproduce, distribute, or create derivative works from any content without our prior written consent. Memorial content uploaded by users remains the property of the uploading user.
To the fullest extent permitted by law, Always With Us shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability for any claim arising under these terms shall not exceed the amount you have paid to us in the twelve months preceding the claim.
We reserve the right to suspend or terminate your account and access to our services at any time, with or without notice, for any reason, including breach of these terms. Upon termination, your memorial pages may be unpublished and removed from our platform.
These Terms and Conditions are governed by the laws of the Republic of Singapore. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
